August 2021 in Kraft getreten ist, und die nachfolgenden Bewilligungsrichtlinien der Eidgen\u00f6ssischen Finanzmarktaufsicht (FINMA) bietet die Schweiz einen attraktiven rechtlichen und regulatorischen Rahmen f\u00fcr DLTs.<\/p>\n<p>Die FINMA macht die erforderliche Regulierung von der Art des Tokens abh\u00e4ngig, d.h. Payment, Utility, Investment Tokens und Hybrid Tokens. Die Klassifizierung eines Tokens h\u00e4ngt von der urspr\u00fcnglichen Absicht und nicht von der m\u00f6glichen Nutzung ab. Der Schweizer Gesetzgeber hat zwar neue Regelungen eingef\u00fchrt, die sich auf die innovative Technologie beziehen, doch bezieht sich die Verordnung meist auf das bestehende Recht, das nun auf die jeweilige Art von Token angewendet wird.<\/p>\n<ul>\n<li><strong>Payment Token<\/strong> sind eine alternative Zahlungsmethode. Beispiele f\u00fcr Zahlungstoken sind Bitcoin (BTC) und Ether (ETH), die native W\u00e4hrung der Ethereum-Plattform.<\/li>\n<li><strong>Utility Token<\/strong> erm\u00f6glichen den Zugang zu einer vom Emittenten angebotenen Ware oder Dienstleistung. Wenn der Anleger den Utility Token zum Kauf eines anderen Produkts oder einer anderen Dienstleistung verwenden m\u00f6chte, muss er ihn zun\u00e4chst gegen eine andere &#8211; legale oder kryptografische &#8211; W\u00e4hrung eintauschen.<\/li>\n<li><strong>Investment Token<\/strong> sind eine tokenisierte Version eines Verm\u00f6genswerts, der einen Anteil an dem Unternehmen verk\u00f6rpert, das den Token ausgegeben hat. W\u00e4hrend Payment und Utility im Allgemeinen nicht als Wertpapiere angesehen werden, sind Investment Token es schon, und die <strong>Vorschriften f\u00fcr den Wertpapierhandel gelten auch<\/strong> f\u00fcr Investment Token.<\/li>\n<li><strong>Hybride Token: <\/strong>\u00a0Oft fallen Token in mehrere Kategorien von Token, z. B. k\u00f6nnen Utility- und Investment-Token als Zahlungsmittel verwendet werden. In diesen F\u00e4llen gelten f\u00fcr den hybriden Token die Vorschriften f\u00fcr alle relevanten Arten von Token.<\/li>\n<\/ul>\n<p>Mit dem DLT-Gesetz wurden entsprechende rechtliche Verbesserungen eingef\u00fchrt:<\/p>\n<ul>\n<li><strong>Ledger-basierte<\/strong> <strong>Wertpapiere<\/strong> erm\u00f6glichen die Digitalisierung von Aktien und anderen Rechten<\/li>\n<li><strong>DLT \/ Security Token<\/strong> <strong>Exchange<\/strong> als neue Form der Zulassung von Handelspl\u00e4tzen f\u00fcr digitale Verm\u00f6genswerte mit geringeren Anforderungen f\u00fcr kleine Handelseinrichtungen<\/li>\n<li>Erleichterung der Anforderungen an <strong>Verwahrstellen f\u00fcr digitale Verm\u00f6genswerte<\/strong><\/li>\n<li>Richtlinien zur Ausgabe von<strong> digitalen Verm\u00f6genswerten im Falle eines Konkurses<\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Mit dem Bundesgesetz \u00fcber die Anpassung des Bundesrechts an die Entwicklungen der Distributed Ledger Technology (DLT-Gesetz) und der entsprechenden Verordnung \u00fcber die Anpassungen des bestehenden Rechts, die am 1.
