Sanctions that hit ordinary Russian passport holders.<\/div>\n<div>\n<p>5. Difficulty in applying foreign law leads to the majority of persons affected are not targeted by the sanctions.<\/p>\n<\/div>\n<p>4) and 5) leads to an increased workload for authority and banks as gatekeepers.<\/p>\n<h5>Are you trading goods that are purchased from Russia or originate in Russia?<\/h5>\n<p><u>Not all goods coming from Russia <\/u>into the EU or Switzerland are subject to the Swiss\/EU or US sanctions. Secondary sanctions<\/h5>\n<p>Compliance\u00a0and risk assessment procedures are required to prevent sanctions circumvention:\u00a0<strong>&#8220;No re-export to Russia&#8221;<\/strong> clause.<\/p>\n<p><strong>13th package adopted on 23 February 2024:<\/strong><br \/>\n27 new entities that were involved in the circumvention of trade sanctions located in:<\/p>\n<p style=\"padding-left: 40px;\">\u2713India,<br \/>\n\u2713Sri Lanka,<br \/>\n\u2713China,<br \/>\n\u2713Serbia,<br \/>\n\u2713Kazakhstan,<br \/>\n\u2713Thailand, and<br \/>\n\u2713Turkey were added to the sanctions list.<\/p>\n<p>They will be subject to tighter export restrictions concerning dual-use goods and technologies.<\/p>\n<h5>Does your parent company have sanctioned individuals or companies as shareholders, CEOs or Board members?<\/h5>\n<p>If your\u00a0parent company\u00a0is incorporated in Russia and has sanctioned individuals (or companies) as CEOs, Board members or shareholders, <u>Swiss or EU banks may freeze your bank account<\/u>. In this case, legal opinion with analysis of the ownership and control may help Swiss, EU banks unfreeze your account. SECO and EU local sanctions authorities may also issue confirmations that sanctions do not apply to your company.<\/p>\n<h5>Do you deal with a company incorporated in Russia?<\/h5>\n<\/div>\n<div>\n<p>It is generally, <u>not prohibited <\/u><u>to <\/u><u>enter into<\/u><u> business relationships with companies incorporated in Russia<\/u>.<br \/>\nEven if your business partner is not sanctioned itself, the business structure of your Russian business partner has to be checked: are there any sanctioned shareholders or sanctioned individuals serving as CEOs or Board members of the shareholders?<\/p>\n<h5>Do you provide services to Russian nationals or Russian companies?<\/h5>\n<p>Certain services to companies incorporated in Russia are prohibited, such a<\/p>\n<p style=\"padding-left: 40px;\">\u2713accounting,<br \/>\n\u2713audit,<br \/>\n\u2713public relationship,<br \/>\n\u2713bookkeeping,<br \/>\n\u2713legal,<br \/>\n\u2713architectural services and others.<\/p>\n<p>These services <u>to Russian individuals<\/u> <strong>are allowed<\/strong>. There are prohibitions with respect to trusts and similar legal arrangements with Russian individuals residing in Russia as beneficiaries or trustors.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Main Goals of European and Swiss Sanctions: 1.
