La Suisse offre un cadre juridique et r\u00e9glementaire attrayant pour les DLT.<\/p>\n<p>La FINMA fait d\u00e9pendre la r\u00e9glementation requise du type de tokens, \u00e0 savoir les tokens de paiement, d&rsquo;utilit\u00e9, d&rsquo;investissement et les tokens hybrides. La classification d&rsquo;un token d\u00e9pend de l&rsquo;intention initiale et non de l&rsquo;utilisation possible. Bien que le l\u00e9gislateur suisse ait introduit de nouvelles r\u00e9glementations relatives \u00e0 la technologie innovante, la r\u00e9glementation se r\u00e9f\u00e8re principalement \u00e0 la loi existante qui s&rsquo;applique d\u00e9sormais au type de tokens concern\u00e9.<\/p>\n<ul>\n<li><strong>Les jetons de paiement<\/strong> sont une m\u00e9thode de paiement alternative. Le Bitcoin (BTC) et l&rsquo;Ether (ETH), qui est la monnaie native de la plateforme Ethereum, sont des exemples de jetons de paiement.<\/li>\n<li><strong>Les jetons d&rsquo;utilit\u00e9<\/strong> permettent d&rsquo;acc\u00e9der \u00e0 un bien ou \u00e0 un service offert par l&rsquo;\u00e9metteur. Si l&rsquo;investisseur souhaitait utiliser l&rsquo;Utility Token pour acheter un autre produit ou service, il devrait d&rsquo;abord l&rsquo;\u00e9changer contre une autre monnaie &#8211; l\u00e9gale ou crypto.<\/li>\n<li><strong>Les tokens d&rsquo;investissemen<\/strong>t sont une version tokenis\u00e9e d&rsquo;un actif qui incarne une action dans la soci\u00e9t\u00e9 qui a \u00e9mis le token. Alors que le paiement et l&rsquo;utilit\u00e9 ne sont g\u00e9n\u00e9ralement pas consid\u00e9r\u00e9s comme des titres, les tokens d&rsquo;investissement le sont et <strong>les r\u00e9glementations sur le commerce des titres s&rsquo;appliquent<\/strong> aux tokens d&rsquo;investissement.<\/li>\n<li><strong>Token hybride<\/strong> : Souvent, les tokens rel\u00e8vent de plusieurs cat\u00e9gories de tokens, par exemple les tokens d&rsquo;utilit\u00e9 et les tokens d&rsquo;investissement peuvent \u00eatre utilis\u00e9s comme m\u00e9thode de paiement.
