Le Liechtenstein est devenu un pionnier en 2018 en lan\u00e7ant sa loi sur les fournisseurs de services de tokens et de technologies dignes de confiance (\u00ab TVTG \u00bb) qu&rsquo;il a depuis adapt\u00e9e et am\u00e9lior\u00e9e et qui a apport\u00e9 une s\u00e9curit\u00e9 juridique aux droits existants qui sont tok\u00e9nis\u00e9s.<\/p>\n<p>Le Liechtenstein a adapt\u00e9 un <strong>mod\u00e8le innovant pour r\u00e9glementer tous les types de jetons<\/strong> (Container Token Model). Le mod\u00e8le est bas\u00e9 sur deux \u00e9l\u00e9ments &#8211; un conteneur tel que d\u00e9crit dans la d\u00e9finition du jeton technologiquement neutre et le contenu sp\u00e9cifique. Toutefois, en ce qui concerne les droits repr\u00e9sent\u00e9s par le jeton, une loi sp\u00e9cifique peut s&rsquo;appliquer : Si un titre est repr\u00e9sent\u00e9 dans un jeton, les lois sur les titres s&rsquo;appliquent. Si un instrument financier est repr\u00e9sent\u00e9 dans un token, les lois sur les march\u00e9s financiers peuvent s&rsquo;appliquer, et ainsi de suite.<\/p>\n<p>Les entreprises actives dans le domaine de la FinTech et de la Blockchain peuvent avoir besoin d&rsquo;une licence,<strong> d&rsquo;un enregistrement et\/ou<\/strong> \u00eatre soumises \u00e0 <strong>l&rsquo;exigence d&rsquo;une fiche d&rsquo;information<\/strong> de base.<\/p>\n<p><strong>a) Enregistrement<\/strong><\/p>\n<p>Les prestataires de services de TT doivent s&rsquo;enregistrer aupr\u00e8s de la FMA avant d&rsquo;offrir commercialement leurs services au Liechtenstein et sont ensuite inscrits dans le registre public. Seuls les \u00e9metteurs de jetons, qui \u00e9mettent des jetons en leur propre nom et non professionnellement \u00e0 des tiers, sont exempt\u00e9s de cette obligation si les jetons \u00e9mis valent moins de 5 millions sur 12 mois. Les autres services fournis \u00e0 des tiers doivent \u00eatre enregistr\u00e9s, m\u00eame si la valeur des jetons \u00e9mis est inf\u00e9rieure \u00e0 5 millions d&rsquo;euros sur 12 mois.<\/p>\n<p>Les prestataires de services doivent remplir les crit\u00e8res suivants pour \u00eatre inscrits au registre :<\/p>\n<ul>\n<li>Capacit\u00e9 juridique<\/li>\n<li>Fiabilit\u00e9<\/li>\n<li>Qualification professionnelle<\/li>\n<li>R\u00e9sidence au Liechtenstein<\/li>\n<li>Capital minimum<\/li>\n<li>Structure organisationnelle appropri\u00e9e<\/li>\n<li>Proc\u00e9dures internes et m\u00e9canismes de contr\u00f4le<\/li>\n<li>Exigences en mati\u00e8re de licence, par exemple fiduciaire, bancaire et financi\u00e8re<\/li>\n<\/ul>\n<p>D&rsquo;autres obligations d&rsquo;information s&rsquo;appliquent.<\/p>\n<p><strong>b) Fiche d&rsquo;information de base<\/strong><\/p>\n<p>Les \u00e9metteurs de jetons doivent publier des informations avant l&rsquo;\u00e9mission et notifier l&rsquo;\u00e9mission \u00e0 l&rsquo;AFM, sauf exceptions.
