Ils ne font que redistribuer la p\u00e9nurie. C&rsquo;est pr\u00e9cis\u00e9ment l\u00e0 que r\u00e9side le probl\u00e8me de la vague de r\u00e9glementations en mati\u00e8re de politique du logement qui d\u00e9ferle actuellement sur la Suisse. Le 14 juin, Zurich se prononcera sur l&rsquo;initiative pour la protection du logement. B\u00e2le a d\u00e9j\u00e0 montr\u00e9 ce qui en d\u00e9coule. Berne, Gen\u00e8ve et Vaud examinent des r\u00e8gles similaires. Ce qui ressemble \u00e0 de la politique sociale cantonale est en fait une d\u00e9cision d\u2019orientation en mati\u00e8re de politique du logement pour l\u2019ensemble du pays \u2014 une Suisse qui se dirige vers les dix millions d\u2019habitants.<\/p>\n<p>Le diagnostic est correct : dans les villes o\u00f9 les taux de vacance sont faibles, o\u00f9 les co\u00fbts de construction augmentent et o\u00f9 la pression migratoire est soutenue, le logement est devenu une question de r\u00e9partition. Le logement abordable est un objectif politique l\u00e9gitime. Les moyens, en revanche, sont sujets \u00e0 d\u00e9bat.<\/p>\n<blockquote>\n<h4><em>\u00ab Le prix n\u2019est pas la cause de la p\u00e9nurie de logements. C\u2019est son sympt\u00f4me. Ceux qui ne r\u00e9glementent que le prix s\u2019attaquent au thermom\u00e8tre au lieu de la fi\u00e8vre. \u00bb<\/em><\/h4>\n<\/blockquote>\n<h2>Le sophisme politiquement s\u00e9duisant<\/h2>\n<p>Les plafonds de loyer pr\u00e9sentent un grand avantage : ils sont faciles \u00e0 expliquer. Les loyers sont \u00e9lev\u00e9s \u2014 alors limitons-les. C\u2019est accrocheur, \u00e9motionnellement plausible et pr\u00eat pour un r\u00e9f\u00e9rendum.<\/p>\n<p>Sur le plan \u00e9conomique, c\u2019est trop simpliste. Le prix n\u2019est pas la cause de la p\u00e9nurie de logements. C\u2019est son sympt\u00f4me. Des loyers \u00e9lev\u00e9s indiquent qu\u2019il y a trop peu de logements l\u00e0 o\u00f9 les gens veulent vivre. Ceux qui ne r\u00e9glementent que le prix sans augmenter l\u2019offre s\u2019attaquent au thermom\u00e8tre plut\u00f4t qu\u2019\u00e0 la fi\u00e8vre.<\/p>\n<p>\u00c0 court terme, les plafonds de loyer peuvent soulager les m\u00e9nages individuels \u2014 cela ne fait aucun doute. \u00c0 moyen terme, ils cr\u00e9ent de mauvaises incitations : moins d\u2019investissements, moins de r\u00e9novations, plus de proc\u00e9dures bureaucratiques, plus de man\u0153uvres d\u2019esquive. Au final, il n\u2019y a pas plus d\u2019appartements abordables, mais moins d\u2019appartements disponibles.<\/p>\n<div class=\"ast-oembed-container \" style=\"height: 100%;\"><iframe title=\"Plafonnement des loyers et p\u00e9nurie de logements : les le\u00e7ons de B\u00e2le\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/wVRjIV7Yu8g?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<h2>B\u00e2le met en garde<\/h2>\n<p>B\u00e2le-Ville en est l\u2019exemple \u00e9difiant en temps r\u00e9el. Depuis 2022, des r\u00e8gles strictes de protection du logement sont en vigueur. R\u00e9sultat : baisse des contrats de r\u00e9novation, nouvelles proc\u00e9dures d\u2019autorisation, risques de litiges et p\u00e9riodes de contr\u00f4le s\u2019\u00e9talant sur plusieurs ann\u00e9es. Certaines r\u00e8gles ont d\u00e9j\u00e0 d\u00fb \u00eatre assouplies \u00e0 compter de novembre 2025, car les r\u00e9novations \u00e9taient trop fortement frein\u00e9es.<\/p>\n<p>Les chiffres parlent d&rsquo;eux-m\u00eames. Dans le cadre de la proc\u00e9dure simplifi\u00e9e de protection du logement, le retour sur investissement des co\u00fbts de construction pour une r\u00e9novation tombe \u00e0 1,3 %, contre 2,7 \u00e0 3,4 % dans le cadre du droit suisse standard des baux. Avec les taux d&rsquo;int\u00e9r\u00eat, les exigences r\u00e9glementaires et les co\u00fbts de construction actuels, personne ne r\u00e9nove pour 1,3 %. Ce n&rsquo;est pas un hasard. C&rsquo;est le r\u00e9sultat pr\u00e9visible d&rsquo;un syst\u00e8me qui rend l&rsquo;investissement plus difficile et plafonne politiquement les rendements.<\/p>\n<p>Les r\u00e9novations \u00e9nerg\u00e9tiques, les mises \u00e0 niveau techniques des b\u00e2timents, les r\u00e9novations compl\u00e8tes \u2014 pr\u00e9cis\u00e9ment ce qu\u2019exigent les objectifs climatiques \u2014 ne sont plus viables financi\u00e8rement. Une maison fig\u00e9e par la r\u00e9glementation n\u2019est pas plus sociale. Elle est simplement plus vieille.<\/p>\n<h2>Construire, ne pas bloquer<\/h2>\n<p>La principale faille de la politique sociale du plafonnement des loyers r\u00e9side dans son ciblage. Elle n\u2019aide pas en premier lieu ceux qui en ont le plus besoin. Elle aide ceux qui ont d\u00e9j\u00e0 acc\u00e8s au parc immobilier r\u00e9glement\u00e9.<\/p>\n<p>Ceux qui disposent d\u2019un appartement r\u00e9glement\u00e9 abordable restent sur place. M\u00eame s\u2019il est devenu trop grand. M\u00eame s\u2019ils changent de lieu de travail. Chaque d\u00e9m\u00e9nagement devient une p\u00e9nalit\u00e9 financi\u00e8re, car le nouveau loyer sera plus \u00e9lev\u00e9. Cela cr\u00e9e des effets de verrouillage : des personnes seules dans des appartements familiaux, des familles sans acc\u00e8s \u00e0 des logements plus grands, une mobilit\u00e9 professionnelle en baisse. Le parc immobilier existant est utilis\u00e9 de mani\u00e8re moins efficace.<\/p>\n<p>La bonne r\u00e9ponse est d\u2019augmenter l\u2019offre : acc\u00e9l\u00e9rer l\u2019octroi des permis, densifier la construction, activer les sites de d\u00e9veloppement et raccourcir les proc\u00e9dures. Et un changement de mentalit\u00e9 vis-\u00e0-vis de la construction est n\u00e9cessaire. Une Suisse de dix millions d\u2019habitants n\u2019est pas une menace pour l\u2019am\u00e9nagement du territoire \u2014 c\u2019est un d\u00e9fi de conception. Des quartiers \u00ab 15 minutes \u00bb, des b\u00e2timents \u00e0 \u00e9nergie positive, de nouveaux concepts de mobilit\u00e9 : tout cela se construit d\u00e9j\u00e0 aujourd\u2019hui, \u00e0 Rotkreuz, \u00e0 Hambourg, \u00e0 Copenhague. Ce n\u2019est pas de terrains qu\u2019il manque. C\u2019est la s\u00e9curit\u00e9 des investissements.<\/p>\n<p>Les objectifs sociaux peuvent \u00eatre atteints de mani\u00e8re plus pr\u00e9cise : construction de logements \u00e0 but non lucratif, allocations de logement cibl\u00e9es, r\u00e8gles d\u2019am\u00e9nagement avec des rendements calculables. La contre-proposition \u00e0 l\u2019initiative de Zurich va dans ce sens.<\/p>\n<p>La p\u00e9nurie de logements est bien r\u00e9elle. C\u2019est pr\u00e9cis\u00e9ment pour cette raison qu\u2019il ne faut pas y r\u00e9pondre par une politique symbolique. Un plafonnement des loyers ne cr\u00e9e pas un seul m\u00e8tre carr\u00e9 de logement suppl\u00e9mentaire. Il augmente les co\u00fbts de proc\u00e9dure, ralentit les r\u00e9novations et fait peser la p\u00e9nurie sur ceux qui n\u2019ont pas encore d\u2019appartement. Ce qui ressemble \u00e0 de la protection n\u2019est en r\u00e9alit\u00e9 que la gestion de la p\u00e9nurie sous un label social.<\/p>\n<p>Les plafonds de loyer ne r\u00e9solvent pas la p\u00e9nurie de logements en Suisse \u2013 ils l&rsquo;aggravent.
