Wie Sie wissen legen wir f\u00fcr unsere Kunden (UHNWI, institutionelle Investoren und Asset Manager) Fonds in Standorten wie Luxembourg, Liechtenstein, Malta, Cayman Islands und der Schweiz auf.<\/p>\n<p>Zum Thema Depotbank beim L-QIF gestatten Sie mir folgende Anregung:<\/p>\n<p>Liberalisierung beim Depotbankerfordernis nach ausl\u00e4ndischem Vorbild<br \/>\nEin Wettbewerbsnachteil des Schweizer Fondsrechts gegen\u00fcber flexiblen Fondsformen in Cayman Islands oder Malta sind die regiden Zustimmungsvorschriften der Depotbanken. Beim maltesischen Professional Investor Fund (sog. \u00abPIF\u00bb, d.h. ein Below-Threshold AIF unter EUR 100 mio bzw. 500 mio) bedarf es beispielsweise gar keiner Depotbank mit Kontrollfunktionen, die Kontrolle wird ja bereits vom Board of Direktors des Fonds und dem Wirtschaftspr\u00fcfer durchgef\u00fchrt. Eine weitere zus\u00e4tzliche 3fach-Kontrolle wir seitens Investoren oder Asset Manager als Overkill empfunden. Es w\u00e4re zu empfehlen, dies Flexibilisierung hinsichtlich Depotbankerfordernis mit Kontrollfunktion beim L-QIF ebenfalls einzuf\u00fchren. Es sollte gen\u00fcgen, wenn der L-QIF ein ganz normales Firmenkonto (\u00abCorporate Account\u00bb) er\u00f6ffnet, eine Depotbank mit Kontrollfunktionen bedarf es nicht, diese Option sollte auch der schweizerische Gesetzgeber er\u00f6ffnen. Entsprechend sollte jede Bank mit Bewilligung einen L-QIF das Bankkonto er\u00f6ffnen k\u00f6nnen, nicht nur solche Banken, welche speziell als Fondsdepotbank zugelassen sind.<\/p>\n<p>Andernfalls m\u00fcssen Privatbanken f\u00fcr UHNWI, institutionelle Investoren und Asset Manager auf Fonds anderer Jurisdiktionen zur\u00fcckgreifen ohne dass der schweizerische L-QIF eingesetzt werden kann. Wie Sie v\u00f6llig zurecht schreiben, machen die UHNWI und institutionellen Anleger eine Due Diligence selbst und der Markt kann dann entscheiden ob sich L-QIFs mit oder ohne Depotbank mit Kontrollfunktion durchsetzen.
