What rights do Sanctioned Persons have?

European Union:
Right to a fair trial. Article 6 ECHR

1. Impossibility to provide evidence
2. Improper notification. Short notification periods for SDNs.

United States:

Article 14. International Covenant on Civil and Political Rights. Adopted by UN GA, 1966
“everyone shall be entitled to a fair and public hearing by a competent, independent and impartial tribunal established by law”.

Switzerland:
Right to property (Article 1 of Protocol 1 to the ECHR).
Invoked when assets are frozen.

Articles 6, 7, 17 UDHR – “a milestone document”
Esp. Art. 7: All are equal before the law and are entitled without any discrimination to equal protection of the law.

  • Wrong – Hard to prove.
